The Board of Standards and Appeals, on July 12, agreed to exempt the design of 430 East 58th Street from the height limits imposed by new zoning laws passed prior to construction of the building’s foundation.
Further work at the site is on hold until the BSA issues its written decision. Meanwhile, the East River Fifties Alliance is preparing to appeal for a reversal in New York State Supreme Court. The appeal application process could take from one to two years, during which the developer, Gamma, might possibly resume construction. If so, ERFA plans to seek a stop order to halt work until the final court decision comes down.
Council Member Ben Kallos, 5th District, said, “We are not done fighting, and I will be part of the lawsuit that is filed against the City to prevent this project from going up as planned by the developer.”
